We reviewed 2 quality statements and found a breach in the legal regulation of person-centred care. Peoples care plans were not always kept up to date and relevant. Capacity assessments and best interests assessments had not been reviewed or updated despite people’s needs changing. However one person who was new to the service did have up to date care plans in place.

Assessing needs

People’s records were not always up to date. The current needs of 2 people were not reflected in their care plans. Most people's records had not been reviewed to ensure the were still appropriate and effective. This put people at risk of receiving support that was not appropriate for them. One person had recently moved to the house and had an up to date care plan including guidance provided by professionals to encourage their independence in the home.

The registered manager told us that 1 person’s support needs had significantly changed however this was not reflected in their care and support plans which had not been updated The registered manage had audited peoples files in December 2023 sand had identified issues with them being out of date but there had been no action taken to address this at the time of the assessment.

One person did not have a picture on their missing person information, another person had a picture that did not reflect their current appearance, this meant that the provider could not be assured they could provide the relevant information to Police if required.

We saw some capacity and best interest assessments for people however these had not been reviewed and updated in a timely way. This meant that the provider could not be assured that they were in line with people’s current needs and wishes. People had hospital passports in place, the manager told us they would support anyone who had to stay in hospital to ensure they were treated safely.

One person had a change in their health and their needs, but the registered manager could not demonstrate they had recorded these changes and the impact on the person.

The provider had processes in place to assess capacity for people and also to facilitate best interest decisions if needed, however the records see were not up to date and had not been reviewed. Whilst the provider had assessed capacity and completed best interests for some decisions such as using sun tan lotion they had not completed the appropriate action for all decisions people made. This meant they could not be assured that people were reviving support that was person centred and in line with Right support, right car, right culture.
