We identified a breach of regulation in relation to good governance. The provider and registered manager failed to ensure systems and processes operated effectively to ensure compliance with the regulations and they were operating in breach of their registration conditions. The provider did not respond to our requests for information in a timely way. They did not effectively assess, monitor and improve the quality and safety of the service. They did not identify and mitigate the risks relating to the health, safety and welfare of service users and others who may be at risk. The provider and registered manager failed to maintain an accurate, complete and contemporaneous record in respect of each service user and the care provided.

When we spoke with the provider, they demonstrated a lack of understanding in respect of their responsibilities as both a provider and a registered manager. It was evident they were not familiar with guidance for providers on meeting the regulations or fundamental standards. They did not understand the legal requirements to be correctly registered and they failed to maintain compliance because they did not provide a consistently safe and effective service.

There was a lack of oversight at the service and quality assurance processes were ineffective. The audits of care records had not identified that care plans and risk assessments were not accurate or fit for purpose. Medicines audits had not identified that medicines were not being managed appropriately and people were not always receiving their medicines safely and as prescribed. The provider’s checks and audits had not identified that people using the service were being subjected to unlawful restrictive practices. The provider did not respond to our requests for information in a timely way. Timescales were not met when information was requested via email. This resulted in the need to make formal requests on two separate occasions using our legal powers. The deadlines stated in the formal requests were then met. The provider failed to ensure the regulations were complied with in order to keep people safe and they were operating in breach of their registration conditions.
